Road Traffic & Motoring Offences
Solicitor For Motoring Offences “Protecting your licence, livelihood, and reputation.” Being accused of drink driving does not automatically mean you will be convicted or lose your licence. As a specialist solicitor for motoring offences, I know these cases often turn on whether police procedures were followed correctly and whether the evidence is reliable.

Road Traffic Solicitor Covering London
Motoring cases in London, drink and drug driving, totting-up, and Section 172 allegations, are heard at London's Magistrates' Courts, and I regularly represent privately paying clients at these hearings, either in person or by remote CVP link where the court permits it. London cases are a priority for my services, with the same fast, personal response you'd get anywhere I cover.
I don't currently have a walk-in office in London, attendance is at court, or via remote CVP link, which is how most motoring defence work is actually delivered. What matters is that your case is prepared properly and argued by the same specialist throughout, whether you're in London, Manchester, or anywhere in England and Wales.
Why These Cases Are Often Winnable
Being accused of drink driving does not automatically mean you will be convicted or lose your licence. As your road traffic solicitor, I examine issues such as:
Whether breath or blood samples were lawfully obtained
Whether testing equipment was properly calibrated and used
The timing of samples and continuity of evidence
Whether medical conditions, anxiety, or confusion affected the process
Even where an offence is proven, I can often advance special reasons or mitigation to reduce the length of any disqualification or penalty.
Comprehensive Road Traffic Defence
As a dedicated traffic offence solicitor, I act in all types of motoring matters, including:
Drink Driving
Drug Driving
Failing to Provide a Specimen
Dangerous or Careless Driving
Driving Without Insurance or Licence
Speeding Offences
Totting-Up and Exceptional Hardship Applications
Special Reasons Arguments
Failing to Stop or Report an Accident
Mobile Phone and Seatbelt Offences
No matter the allegation, I will carefully analyse the evidence, police procedure, and technical aspects of your case to identify defences, loopholes, or mitigating circumstances that could make a crucial difference.
Instructing a Specialist vs. Pleading Guilty by Post
Aftab Bakhat (Road Traffic Solicitor) | Pleading Guilty by Post / DIY | |
Evidence checked | Full review of procedure, calibration, continuity | Not checked |
Special reasons/mitigation | Prepared and argued in court | Rarely raised |
Exceptional hardship applications | Built with evidence and submissions | Almost never succeeds unrepresented |
Outcome | Often reduced penalty or no disqualification | Standard penalty applied |
Cost | Fixed fee, agreed upfront | "Free", but no defence considered |
Drink Driving
Being accused of drink driving doesn't automatically mean you are guilty or will lose your licence. As your road traffic solicitor, I regularly defend clients accused of driving with excess alcohol by examining:
Whether breath or blood testing procedures were correctly followed under the Road Traffic Act 1988 and PACE
The timing of the test, calibration of devices, and continuity of samples
Whether you were under duress, unfit due to medical conditions, or confused about the procedure
Potential "hip flask" defences, where alcohol was consumed after driving but before testing
Where the evidence is strong, I can still mitigate to reduce disqualification and penalty through special reasons or personal mitigation.
Drug-Driving
Drug-driving cases are increasingly complex and frequently misunderstood. A positive result does not always mean impairment at the time of driving. I carefully assess:
Toxicology results and laboratory certificates (SFR1 and SFR2)
Continuity and handling of blood samples
Whether prescribed medication or medical cannabis may explain the reading
Whether the prosecution can prove impairment where required
Where statutory procedures have not been followed, I can apply to have evidence excluded. Where conviction is unavoidable, I focus on reducing the impact on your licence and livelihood.
Failing to Provide a Specimen
You can only be convicted of failing to provide if the prosecution can prove you wilfully refused or failed to give a sample without reasonable excuse. As a specialist road traffic solicitor, I have successfully defended clients unable to provide due to:
Medical anxiety, needle phobia, or panic attacks
Asthma or breathing difficulties during breath tests
Misunderstanding police instructions due to stress or confusion
In these cases, I often rely on medical and psychiatric reports to demonstrate that your failure was genuine — not deliberate.
Careless or Dangerous Driving
Allegations of careless or dangerous driving depend heavily on how the driving is assessed and reconstructed. I examine:
Police observations and body-worn video
Collision evidence and accident reconstruction where relevant
Whether the driving meets the legal threshold for the charge
Whether a lesser offence or alternative disposal is appropriate
These cases often involve negotiation and careful legal argument to ensure the charge properly reflects the evidence.
Speeding Offences
Speeding cases are not always as straightforward as they appear. Convictions depend on strict compliance with technical requirements. I consider:
Whether speed detection devices were approved, calibrated, and used correctly
Whether signage and speed limits were lawfully in place
Whether a procedural or evidential challenge is available
Where points or disqualification are unavoidable, I focus on mitigation or exceptional hardship where applicable.
Failing to Provide Information (Section 172 Road Traffic Act)
Allegations under section 172 are often more complex than they first appear, conviction depends on whether the prosecution can prove you failed to comply without reasonable diligence or reasonable excuse. I regularly advise clients who:
Failed to identify the driver despite genuine efforts to do so
Returned incomplete or disputed information
Are accused of providing incorrect details
Are investigated for alleged false nominations or so-called "NIP farms"
These cases involve close examination of correspondence, timelines, postal evidence, and mobile phone data. Early advice is particularly important, as procedural missteps can be difficult to undo later.
Special Reasons & Totting-Up / Exceptional Hardship
Even if you plead guilty, "special reasons" can avoid a disqualification altogether, for example, if you drove only a short distance, had no intention of driving further, were unaware you were over the limit, or drove due to a genuine emergency.
Separately, if you accumulate 12 or more penalty points, the court must disqualify you for at least 6 months unless exceptional hardship is proven. I prepare detailed, evidence-backed applications addressing the impact on your employment or business, the effect on family members or dependants, and any medical or personal circumstances that make driving essential, supported by letters, employer evidence, and structured submissions.
